1. About These Terms

These Terms of Service ("Terms") govern your access to and use of the BAMJOY platform at www.bamjoy.com, including all features, content, and services offered by BAMJOY LTD ("BAMJOY", "we", "us", "our").

By creating an account or using BAMJOY, you agree to these Terms. If you do not agree, please do not use the service.

2. Eligibility

2.1 Account Holders

You must be at least 18 years of age to create a BAMJOY account. By registering, you confirm that you are 18 or over and are either:

• A parent or legal guardian using the service on behalf of a child, or
• An individual using the service for personal, non-commercial purposes

2.2 Children

BAMJOY is designed for children to use under the supervision of a parent or guardian. Children may not create their own accounts. All child profiles are created and managed by the account-holding adult, who is responsible for all activity within their account.

2.3 Geographic Availability

BAMJOY is operated from the United Kingdom. The service is available internationally; however these Terms are governed by the laws of England and Wales.

3. Your Account

3.1 Registration

When you register, you agree to provide accurate, current, and complete information. You are responsible for maintaining the accuracy of your account details.

3.2 Account Security

You are responsible for keeping your password secure and for all activity that occurs under your account. You must notify us immediately at contact@bamjoy.com if you suspect unauthorised access to your account.

3.3 One Account Per User

Each person may hold one account. Creating multiple accounts to circumvent subscription limits or access restrictions is prohibited.

3.4 Account Suspension and Termination

We reserve the right to suspend or terminate your account without notice if you:

• Breach these Terms
• Use the service for unlawful purposes
• Attempt to circumvent technical restrictions or subscription limits
• Submit content that violates our content standards (see Section 8)

4. Subscription Plans and Billing

4.1 Available Plans

We add new features to plans over time. When we do, subscribers on that plan receive them at no extra cost. Features marked “coming soon” on our Plans page are not included in any plan until they are released.

Prices include VAT where applicable.

4.2 Monthly Story Allowance

Each plan includes the number of stories per month shown above. Allowances reset at midnight (UTC) on the first day of each calendar month, and unused stories do not carry over. If a story fails to generate because of a problem on our side, it is not counted against your allowance. Collection and Heritage subscribers can buy extra stories as described in Section 4.9.

4.3 Billing

Subscriptions are billed in advance on a monthly or annual cycle. Payments are processed securely by Stripe. By subscribing, you authorise BAMJOY to charge your chosen payment method on a recurring basis. For all billing enquiries contact: billing@bamjoy.com

4.4 Annual Subscriptions

Annual subscriptions are charged as a single upfront payment and are covered by our 60-day money-back guarantee described in Section 4.6.

4.5 Price Changes

We will provide at least 30 days' notice of any price changes by email. Continued use of the service after a price change constitutes acceptance of the new pricing.

4.6 Cancellation and Refunds

You may cancel your subscription at any time from your Account settings. Cancellation takes effect at the end of your current billing period — you retain full access until that date.

We offer a full 60-day money-back guarantee on monthly and annual subscriptions. If you are not completely happy, email billing@bamjoy.com within 60 days of your initial subscription purchase to request a full refund of the subscription fees paid during that period, no questions asked. This guarantee applies even if you have generated stories under your paid plan.

After the 60-day money-back guarantee period, subscription fees are non-refundable except where required by law. This guarantee is in addition to, and does not affect, your statutory rights.

To cancel your subscription:

1. Log in to your BAMJOY account
2. Go to Account → Subscription and select "Manage Billing"
3. Choose "Cancel plan" on the secure Stripe billing page
4. Your access continues until the end of your billing period

Alternatively, email billing@bamjoy.com and we will process the cancellation within 2 business days.

4.7 Changing Plan, Upgrades and Downgrades

You can change plan at any time from Account → Manage billing. If you upgrade, your new plan starts straight away and you are charged the difference in price for the rest of your current billing period. If you move to a lower plan, or from yearly to monthly billing, the change takes effect at your next renewal and you keep your current plan until then. No refund is given for a downgrade.

If you downgrade from a paid plan to the Free tier, your paid features remain active until the end of your current billing period. Stories already created are retained in your library. Child profiles exceeding the Free tier limit (1 profile) will become read-only until you upgrade again.

4.8 Free Plan

The Free plan is available to all registered users at no cost and does not expire. Monthly story allowances on the Free plan reset on the first day of each calendar month.

4.9 Story Top-ups

Subscribers on The Collection or The Heritage can buy extra stories as a one-off payment: 5 stories for £7.99, 10 stories for £14.99 or 15 stories for £21.99. Prices include VAT. Top-ups are not a subscription and are not renewed automatically.

Bought stories are used only after your monthly story allowance (including any birthday stories) has been used for that month. They do not expire while you remain on The Collection or The Heritage. If a story fails to generate because of a problem on our side, the bought story is returned to you.

If you move to The Starter or the Free plan, or cancel your subscription, you keep any unused bought stories and can use them for 3 months from the date of that change. If you return to The Collection or The Heritage within those 3 months, your bought stories once again do not expire. Any bought stories still unused after the 3 months will lapse.

Story top-ups are covered by our 60-day money-back guarantee. Email billing@bamjoy.com within 60 days of buying a top-up and we will refund the stories from it that you have not used. This is in addition to, and does not affect, your statutory rights.

5. AI-Generated Content

5.1 How Stories Are Created

BAMJOY uses Google Gemini to generate story text and illustrations based on the settings you provide (genre, character name, age group, themes). Each story is unique and generated on demand.

5.2 Content Quality

While we take steps to ensure generated content is appropriate, age-suitable, and high quality, AI-generated content is not guaranteed to be error-free. If you encounter content that seems inappropriate or inaccurate, please report it to contact@bamjoy.com.

5.3 Ownership of Generated Stories

Stories generated through BAMJOY are created for your personal, non-commercial use. You retain the right to download, print, and share stories created within your account for personal family use.

You may not:

• Resell or commercially exploit AI-generated stories
• Claim authorship of AI-generated content for publication or commercial purposes without disclosure
• Use generated content to train other AI models

5.4 Content Moderation

All story generation requests pass through a profanity and appropriateness filter. Attempts to generate inappropriate, harmful, or adult content will be blocked and logged. Repeated violations may result in account suspension.

6. UK Phonics Engine

The BAMJOY Phonics Engine highlights phonics patterns within stories in line with the DfE Letters and Sounds framework (Phases 2–5). The full Phonics Engine is included on every paid plan. On the Free plan it covers the first 4 pages of each story. The Phonics Engine is provided as an educational aid and is not a substitute for formal phonics instruction.

7. Printed Hardbacks

Printed hardbacks are not currently offered on any plan. If we introduce them, we will update these terms and tell subscribers before any entitlement or charge applies.

8. Acceptable Use

You agree not to use BAMJOY to:

• Generate, store, or share content that is illegal, harmful, abusive, threatening, or obscene
• Generate content that sexualises, endangers, or exploits minors in any way
• Impersonate another person or entity
• Attempt to access another user's account or data
• Reverse engineer, scrape, or copy the BAMJOY platform or its AI outputs at scale
• Use automated tools to generate stories in bulk or circumvent story limits
• Upload viruses, malware, or any code designed to disrupt the service
• Use the service for any commercial purpose without our written consent

9. Child Safety

BAMJOY takes child safety extremely seriously. Our platform is designed with the following safeguards:

• All accounts are held by adults aged 18 or over
• Child profiles contain no contact information or identifying data beyond a first name and age group
• Story generation filters are applied to all AI outputs
• We do not enable direct communication between users
• We report any suspected child sexual abuse material (CSAM) to the Internet Watch Foundation (IWF) and relevant authorities immediately

10. Intellectual Property

10.1 BAMJOY Platform

The BAMJOY platform, including its design, code, branding, logo, and underlying technology, is the intellectual property of BAMJOY LTD. You may not copy, reproduce, or distribute any part of the platform without our written permission.

10.2 Your Content

Any content you upload to BAMJOY (such as child profile names) remains yours. You grant BAMJOY a limited licence to use that content solely for the purpose of delivering the service to you.

10.3 Third-Party Content

BAMJOY integrates third-party services including Google Gemini, Google Cloud, and Stripe. Their respective intellectual property rights remain with them.

11. Disclaimer of Warranties

BAMJOY is provided "as is" and "as available." We do not warrant that the service will be uninterrupted or error-free, that AI-generated stories will meet every expectation, or that the service will be available in all geographic regions at all times. We will make reasonable efforts to maintain service availability and notify users of planned downtime.

12. Limitation of Liability

To the fullest extent permitted by English law, BAMJOY LTD shall not be liable for indirect, incidental, or consequential losses, loss of data beyond what is recoverable from our backups, or losses arising from your use or inability to use the service.

Our total liability to you in any 12-month period shall not exceed the total amount you have paid to us in that period, or £100, whichever is greater.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under English law.

13. Indemnification

You agree to indemnify and hold harmless BAMJOY LTD, its directors, and employees from any claims, damages, or expenses (including legal fees) arising from your breach of these Terms or your misuse of the service.

14. Third-Party Services

BAMJOY integrates with third-party services including Google Cloud, Stripe, and Vercel. Your use of those services is subject to their own terms and privacy policies. We are not responsible for the practices of third-party providers.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of BAMJOY after that date constitutes acceptance of the updated Terms.

16. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of BAMJOY shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you have a complaint, please contact us first at contact@bamjoy.com. We will make every reasonable effort to resolve disputes informally before any legal proceedings are commenced.
